Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Lusty ("we", "us", "our"). They govern your access to and use of the Lusty website, applications, and related services (together, the "Platform"). By creating an account or using the Platform you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Platform.

1. What Lusty is — and is not

Lusty is an online marketplace and directory. It allows independent adult companionship and entertainment providers ("Creators"), and the managers of venues where they may work ("Managers"), to list services, and it allows adult buyers ("Members") to discover those listings, communicate, and arrange bookings.

Lusty lists independent providers. We are not a party to any booking, engagement, or arrangement made between a Member and a Creator or Manager. Bookings are arranged on the Platform but paid directly between the users, off-platform — Lusty does not process, hold, or take any share of booking payments. In particular:

• Creators and Managers are independent operators. They are not our employees, agents, partners, or representatives, and we are not theirs.
• We do not employ, engage, schedule, direct, supervise, or control any Creator or Manager, and we do not set the services they offer or the conduct of any meeting.
• We do not guarantee the availability, quality, legality, safety, or outcome of any service listed on the Platform.
• Any contract for services is formed directly between the Member and the Creator or Manager. We facilitate discovery and messaging only; booking fees are paid directly between the users, off-platform.

2. Eligibility — strictly 18 and over

The Platform is an adult service. You may use it only if you are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and legally able to enter into a binding contract. By using the Platform you represent and warrant that you meet these requirements. We operate an age gate and may require identity and age verification at any time. Accounts that cannot be verified, or that we reasonably believe belong to a minor, will be refused or terminated, and may be reported to the authorities. Creators and Managers are subject to additional verification described in our Trust & Safety and Work Agreements policies.

3. Your account

• You must provide accurate, current, and complete information and keep it up to date.
• You are responsible for all activity under your account and for keeping your credentials confidential. Notify us immediately of any unauthorised use.
• One person may hold one account of each role. You may not sell, share, or transfer your account.
• You may not impersonate any person, misrepresent your age or identity, or use the Platform on behalf of a suspended or banned user.

4. Money, fees, and taxes

Payments are handled through the in-Platform wallet and, for card top-ups, through our third-party payment processor. The headline rules are summarised here and set out in full in our Payments, Refunds & Chargebacks policy, which forms part of these Terms:

• No booking commission. Lusty takes no commission or cut from bookings. Bookings are arranged here and paid directly between the Member and the Creator, off-platform.
• Tips and unlocks. Tips and paid content unlocks are passed on in full — 100% — to the Creator.
• Paid visibility. Creators may optionally pay for front-page placement (advertising). This is how the Platform earns; it is never required in order to receive bookings.
• VAT. Value-Added Tax at the prevailing South African rate (currently 15%) applies to the Platform's own paid services, where applicable.
• Card processing. Card top-ups are processed by CCBill and are billed in US Dollars; the amount is converted to ZAR at the Platform's prevailing rate before crediting your wallet.
• Payouts. On-platform earnings (tips and content unlocks) are paid out weekly on Mondays, subject to holds and review as described in the Payments policy.

You are responsible for your own tax affairs. Creators and Managers are responsible for declaring and paying any income tax, VAT, or other tax due on their earnings.

5. Acceptable use and prohibited conduct

You agree that you will not, and will not attempt to:

• Use the Platform if you are under 18, or facilitate access by, or any content involving, a minor;
• Engage in or facilitate human trafficking, coercion, exploitation, or any non-consensual activity — this is met with an immediate, permanent ban and referral to law enforcement;
• Post content you do not own or have the right to share, or content that is unlawful, non-consensual, or that depicts a person without their consent;
• Attempt to obtain the Platform's own paid services (paid visibility, content unlocks, or wallet top-ups) without paying for them through Lusty, or move first contact off the Platform before a booking is confirmed in a way that evades our safety and verification protections;
• Harass, threaten, defame, stalk, or discriminate against any person;
• Circumvent, disable, or interfere with verification, moderation, security, payment, or geolocation features;
• Scrape, harvest, reverse-engineer, or copy the Platform or other users' data, or upload malware;
• Use the Platform for any unlawful purpose or in breach of these Terms or our other policies.

6. Content you provide

You retain ownership of the content you upload. You grant Lusty a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content solely to operate, promote, and improve the Platform, for as long as you keep it posted (plus a reasonable period for backups and legal compliance). You are solely responsible for your content and warrant that you have all rights and consents necessary to post it.

7. Suspension and termination

You may close your account at any time. We may suspend or terminate your account or access, with or without notice, where we reasonably believe you have breached these Terms or our policies, where required by law, to protect users or the Platform, or in response to a chargeback or fraud signal. On termination, the licences you granted end (subject to retention required by law), and any earnings are settled in accordance with the Payments policy. Provisions that by their nature should survive termination — including sections 4, 8, 9, 10, and 11 — will survive.

8. Disclaimers

To the maximum extent permitted by law, the Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy, or non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, and we make no warranty as to the conduct, identity, legality, or suitability of any Creator, Manager, Member, venue, or listing. Any decision to communicate with or meet another user is made at your own risk. Our safety features reduce risk but do not eliminate it and are not a guarantee of safety — see our Trust & Safety and Liability & Indemnity policies.

9. Limitation of liability

To the maximum extent permitted by law, Lusty and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Platform or any interaction with another user, whether based in contract, delict, or otherwise.

10. Indemnity

You agree to indemnify and hold Lusty harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your use of the Platform, your content, your interactions or arrangements with other users, your breach of these Terms or any policy, or your violation of any law or third-party right.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You and Lusty submit to the exclusive jurisdiction of the South African courts in respect of any dispute arising out of or relating to these Terms or the Platform, subject to any non-waivable rights you have as a consumer under the Consumer Protection Act and related legislation.

12. Changes to these Terms

We may update these Terms from time to time. Where changes are material we will give reasonable notice, for example by posting the updated Terms with a new "Last updated" date and version, or by notifying you in-app. Your continued use of the Platform after the changes take effect means you accept the updated Terms.
