Liability & Indemnity

This policy sets out the limits of Lusty's responsibility, the risks you accept when you use the Platform and meet other people, the safety features we provide, and your obligation to indemnify us. It forms part of our Terms of Service and should be read with our Trust & Safety policy.

1. Lusty is a platform only

Lusty is a marketplace that lists independent Creators and Managers and connects them with Members. We are not a party to any booking, meeting, or arrangement between users, beyond our limited payment-facilitation role. We do not employ, engage, direct, supervise, or vouch for any user, and any agreement for services is formed directly between the users involved. References to us "facilitating" a transaction do not make us a provider, agent, escort agency, employer, or guarantor of any service.

2. No warranty as to users or their conduct

We do not warrant the identity, character, conduct, reliability, legality, or suitability of any Creator, Manager, Member, or venue, or that any listing is accurate. Verification and moderation reduce risk but cannot eliminate it. You are responsible for your own decisions about whom to communicate with, whether to meet, and on what terms. Any reliance you place on another user, a listing, a review, or a badge is at your own risk.

3. Assumption of risk for in-person meetings

Meeting another person carries inherent risk. By arranging or attending any in-person meeting through the Platform, you acknowledge and voluntarily assume those risks, including the risk of misrepresentation, dishonesty, illness, injury, theft, or harm. Lusty is not present at, and has no control over, what happens at any meeting, and is not responsible for the acts or omissions of any user before, during, or after a meeting.

4. Our safety features — what they do and do not promise

To make the community safer, the Platform provides a number of safety features, including:

• Identity and age verification, including a selfie face-match, for Creators and Managers;
• Device-location capture at the point of payment, used for fraud prevention and security;
• Consent and agreement steps, including in-app signed work agreements that record name, signature, selfie, timestamp, and hashes;
• Messaging protections, including automated screening that blocks contact-information sharing before a paid booking, and tools to report and block other users;
• Panic and reporting tools described in our Trust & Safety policy.

5. Limitation of liability

To the maximum extent permitted by law, Lusty and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, data, reputation, or goodwill, arising out of or relating to the Platform or any interaction, communication, transaction, or meeting between users.

6. Indemnity by users

You agree to indemnify, defend, and hold harmless Lusty and its directors, employees, and suppliers from and against any claim, demand, investigation, loss, liability, damage, or expense (including reasonable legal fees) arising out of or relating to:

• Your use of the Platform and your content;
• Your conduct toward, communications with, or arrangements and meetings with any other user;
• Your breach of these policies or the Terms of Service;
• Your violation of any law or of any third party's rights.

7. Force majeure

Lusty is not liable for any failure or delay in performing its obligations where the failure or delay results from events beyond its reasonable control, including acts of God, natural disasters, epidemics, war or civil unrest, strikes, failures of power, internet, hosting, or payment infrastructure, cyber-attacks, or governmental action.

8. Severability

If any provision of this policy is found to be unlawful, void, or unenforceable, that provision is to be enforced to the maximum extent permissible and severed from the remaining provisions, which continue in full force and effect.
