Lusty respects intellectual-property rights and the rights of every person to control intimate images of themselves. This policy explains how to report content that infringes your copyright or that was posted without consent, how the person who posted it can respond, and how we deal with repeat offenders. It forms part of our Terms of Service and works together with our Content & Conduct policy.
1. Reporting infringing content (takedown notice)
If you believe content on the Platform infringes your copyright, send us a takedown notice through our complaints channel. To allow us to act, your notice should include:
- Your name and contact details;
- Identification of the copyrighted work you say has been infringed;
- The specific location of the infringing content on the Platform (for example a profile, post, or message link) so we can find it;
- A statement that you have a good-faith belief that the use is not authorised by you, your agent, or the law;
- A statement, made under penalty of perjury where applicable, that the information in your notice is accurate and that you are the rights holder or authorised to act for them;
- Your physical or electronic signature.
We act on valid notices promptly, typically by removing or disabling access to the content and notifying the person who posted it. Submitting a knowingly false notice may expose you to liability.
2. Non-consensual content — expedited removal
Reports of non-consensual intimate content — including images or video shared without the consent of the person depicted, so-called "revenge" content, hidden-camera material, and deepfakes or other synthetic depictions of a real person — are treated as our highest priority. We aim to remove or disable verified non-consensual content within 24 hours of a valid report, and faster where we can.
Our commitments on non-consensual intimate imagery ("NCII") are:
- You do not need to be the copyright owner to have NCII of yourself removed — being the person depicted, or their authorised representative, is enough;
- We will remove verified NCII expeditiously and take reasonable steps to prevent the same content being re-uploaded;
- We handle these reports with sensitivity and confidentiality, and you do not need to share the content itself to make a report — a clear description and location is enough;
- Where the content may involve a minor or a crime, we preserve evidence as required and refer the matter to law enforcement.
3. Counter-notice
If your content was removed and you believe this was a mistake or that you have the rights and all necessary consents, you may submit a counter-notice through the same channel. A counter-notice should include your contact details, identification of the content that was removed and where it appeared, and a good-faith statement, with your signature, that you have the right and consent to post it. We will review the counter-notice and may restore content where the claim is resolved in your favour. NCII and content that may involve a minor are not eligible for reinstatement through this process.
4. Repeat-infringer and repeat-offender policy
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe the rights of others or who repeatedly post non-consensual content. A single sufficiently serious breach — for example posting NCII or content involving a minor — can result in immediate permanent termination and referral to the authorities, regardless of any prior history.
5. How to contact us
Send takedown notices, NCII reports, and counter-notices through the complaints and reporting tools in the Platform, or to the dedicated complaints contact address published on the Platform. For urgent safety matters, use the in-app reporting tools, and in an emergency contact the SAPS on 10111.
6. Other complaints
For complaints that are not about copyright or non-consensual content — for example conduct, payments, or a dispute with another user — use our general support channel. We aim to acknowledge complaints promptly and to resolve them fairly. Nothing in this policy limits any rights or remedies you have under South African law, including under the Protection of Personal Information Act or the Consumer Protection Act.
